Introduction

Welcome to impactfulgiving.in platform, operated by Impactful Giving Welfare Foundation ("we", "us", or "our"), a Section 8 company incorporated under the Companies Act, 2013 (India). These Terms and Conditions ("T&Cs"), along with any policy or other document referred to herein, govern how a person ("you") can access or use the platform ("Platform"). There could be additional terms that we may apply for your dealings on the Platform.

By using the Platform, you confirm that you have read, understood, and agreed to these T&Cs. If you do not agree, you should not use the Platform.

General Access Terms
  1. Users of the Platform:
    Users of the Platform may include (i) Donors contributing to charitable programs, and (ii) Visitors browsing the Platform for informational purposes. Both types of users are subject to these T&Cs when interacting with the Platform.

  2. Ownership and Responsibility:
    The Platform is owned and operated by Impactful Giving Welfare Foundation. We may engage third-party service providers for certain features and services (such as payment processing), but all responsibilities for the Platform remain with us.

  3. Age Restrictions:
    You must be 18 years or older to access or use the Platform, in compliance with Section 11 of the Indian Contract Act, 1872, which states that a person must be of legal age to enter into contracts. By accessing or using the Platform, you confirm that you are at least the age of majority in your jurisdiction.

  4. Privacy:
    Any information you provide or that we collect, which can identify you, will be used only in accordance with our Privacy Policy, compliant with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 under the Information Technology Act, 2000. We will not share your personal data with third parties except as outlined in the Privacy Policy. Please take a few moments to read our Privacy Policy.

  5. Service Availability:
    We may provide technical support for the Platform, but this is not guaranteed. The Platform may be temporarily unavailable for maintenance, security, or other reasons. We will not be liable for any interruption or downtime that may occur.

  6. Changes to the Platform:
    We reserve the right to modify or discontinue the Platform, or update these T&Cs at any time. Changes will be posted on this page, and users are expected to review the T&Cs periodically to ensure compliance.

Services Offered

  1. Facilitation of Donations:
    The Platform offers donation pages where individuals can contribute to specific charitable “programs” of our partner organisations and broader areas of impact “funds.” All donations are collected by the Impactful Giving Welfare Foundation and disbursed to the intended partner organisations at our discretion in alignment with our charitable objectives. Donations can be made online via the website or by bank transfer, using secure payment methods. Donors may recommend how we should allocate their contributions, either to specific programs or funds. While we consider Donors’ preferences, the allocation of donations is at our sole discretion. If we cannot allocate a donation to the Donor’s chosen option, we will reallocate the donation to an alternative partner organisation or fund, or we may retain the contributions for future use. In either case, we ensure that all donations are used to further our charitable objectives.
     

  2. Third-Party Fees:
    Impactful Giving does not charge fees for donations. However, third-party payment processors may apply standard processing fees, which will be deducted before disbursement to the intended beneficiaries.
     

  3. User Registration:
    Users are not required to create an account to access the Platform. However, to make donations, we will collect your name, email address, physical address, and optionally your PAN card number if you require a tax deduction certificate, in compliance with Indian tax laws, including Section 80G of the Income Tax Act, 1961.

Content and Intellectual Property Rights

All content, logos, and images on the Platform are protected by intellectual property laws under the Copyright Act, 1957 and may not be reproduced or used without our explicit consent. This content is intended for informational and educational purposes only. Partner organisations’ logos and photos are excluded, and we retain the right to use these materials solely for promotional purposes, with appropriate credit to our partners.

Prohibited Conduct
  1. Users agree to use the Platform only for lawful purposes and in compliance with these T&Cs. You agree not to:

  2. Use the Platform in any way that violates any applicable law, including the Information Technology Act, 2000 or any applicable laws regulating data privacy and electronic transactions.

  3. Engage in any activity that could harm or exploit others.

  4. Infringe upon or violate the intellectual property rights of the Platform or third parties, including under the Trademarks Act, 1999.

  5. Misrepresent your identity or affiliation with Impactful Giving or any partner.

  6. Attempt to gain unauthorised access to the Platform or its associated systems.

  7. Interfere with or disrupts the security or integrity of the Platform.

  8. Any violations of this section may result in the termination of your access to the Platform.

Accuracy of Information

While we strive to ensure the accuracy of the information provided on the Platform, we do not guarantee that all information is complete, accurate, or up-to-date. Users are encouraged to independently verify the information before relying on it.

Disclaimer of Warranties

The Platform and all content are provided on an 'as is' and 'as available' basis. We disclaim all warranties, express or implied, regarding the Platform and donations, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that:

  • The information provided on the Platform is accurate, reliable, complete, or timely.

  • The links to third-party websites are accurate, reliable, or complete.

  • Any advice or information, whether oral or written, obtained by you from the Platform will create any warranty not expressly stated herein.

Limitation of Liability
  1. To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform or donations. This includes any loss of profits, data, or business opportunities. We are not liable for any delay or failure in performance due to circumstances beyond our control, including but not limited to natural disasters, war, terrorism, technical failures, or any other force majeure event.

  2. If you are dissatisfied with the Platform, your sole remedy is to discontinue its use.

Indemnification

You agree to indemnify and hold harmless Impactful Giving Welfare Foundation from any claims, damages, liabilities, costs, or expenses, including reasonable attorneys' fees, arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights, including intellectual property rights. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate in our defence.

Payments and Refund Policy

  1. Payments:
    Payments made to Impactful Giving Welfare Foundation can be set up as recurring payments, which can be cancelled or changed by emailing us at team@impactfulgiving.in. We do not charge fees for our activities. The Payment and Settlement Systems Act, 2007 governs online payments through payment gateways or banks.

  2. Refunds:
    All donations are final and non-refundable except in cases of technical errors (such as duplicate payments). Refund requests must be made within 7 days of the donation on team@impactfulgiving.in.

Third-Party Services and Liability

The Platform may contain links to third-party services, which are provided for informational purposes only. We are not responsible for the content or availability of these services. Use of third-party services is at your own risk and is governed by applicable laws including the Information Technology Act, 2000.

If you access or use any third-party services through our Platform, such interactions will be subject to the third party's own terms of use and privacy policies. Impactful Giving is not responsible for the actions, content, or policies of third-party service providers.

Alternative Dispute Resolution

In the event of any dispute or claim arising out of or in connection with these T&Cs or your use of the Platform, both parties agree to first attempt to resolve the dispute amicably through mutual discussion. If such a resolution is not possible, the dispute shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be in Mumbai, India, and the language of arbitration shall be English.

Dispute Resolution

Any disputes arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts located in Mumbai, India. These T&Cs are governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872 and the Companies Act, 2013.
